These Terms of Use govern your use of MLS Daily News (the "Site"), operated by Robert Bolar ("we", "us"). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

1. What the Site is

The Site is an independent news digest about the multiple listing service (MLS) industry. It provides short original summaries of, and links to, reporting published by third parties. The Site is not affiliated with, endorsed by or sponsored by any publisher, MLS, association, brokerage or company mentioned on it. Names and trademarks belong to their owners and are used only to identify the subject of the news.

2. No professional, legal or financial advice

Content on the Site is for general informational purposes only. It is not legal, financial, investment, tax, real estate or other professional advice, and no professional or client relationship is created by your use of the Site. Summaries are based on third-party reports, may be generated in part by automated tools, and may be incomplete or out of date. Always read the original source and consult a qualified professional before acting.

3. Third-party links and content

The Site links to websites we do not control. We are not responsible for their content, accuracy, availability, terms or privacy practices, and a link is not an endorsement. Headlines and the underlying articles belong to their publishers. Allegations reported from lawsuits or other sources are allegations only, not findings of fact. Videos on the Site are embedded with YouTube's official player only where the video's owner allows embedding; they remain hosted by YouTube, belong to the credited channel, and are subject to the YouTube Terms of Service. Views expressed in a video are those of its speakers, not of MLS Daily News.

4. Permitted use

You may use the Site for personal and internal business reading. You may not scrape, copy or republish the Site's summaries in bulk, use the Site to violate any law, interfere with its operation, or attempt to access non-public areas or systems.

5. Intellectual property and copyright complaints

The Site's design and original summaries are owned by us. Copyright complaints are handled under our DMCA policy; publishers may also use our opt-out policy.

6. Disclaimer of warranties

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS.

7. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, AGENTS AND LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM OR RELATED TO THE SITE OR ANY CONTENT OR LINKED SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

8. Indemnification

You agree to indemnify, defend and hold harmless us and our affiliates, agents and licensors from any claims, liabilities, damages, losses and expenses, including reasonable attorneys' fees, arising out of your use or misuse of the Site, your violation of these Terms, or your violation of any rights of another.

9. Governing law and venue

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in the State of Utah, and you consent to their jurisdiction.

10. Changes and contact
